It is Rally Foundation's policy, in appropriate circumstances, to terminate accounts of account holders who are repeat infringers. Notifications of claimed infringement should meet the requirements of 17 U.S.C. §512(c)(3), and we encourage copyright holders to consult an attorney regarding those requirements if they are unfamiliar with them.

2DMCA notice requirements

Required elements for a DMCA notice
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact the complaining party.
- A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner.
3How to file a copyright complaint
Filing process
To file a copyright infringement notice, please send a written communication that includes all required DMCA elements to our designated copyright agent.
- Step 1. Gather all required information and documentation.
- Step 2. Prepare your notice including all DMCA requirements.
- Step 3. Send the notice to our designated copyright agent.
- Step 4. We will review and respond within the legal timeframe.
Important considerations
- False claims may result in liability for damages, including costs and attorney fees.
- Consider whether the use might be protected by fair-use doctrine.
- Ensure you have the authority to act on behalf of the copyright owner.
- Provide specific information to help us locate the allegedly infringing content.
4Counter-notification process
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us.
Counter-notification requirements
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of Federal District Court.
- A statement that you will accept service of process from the complaining party.
What happens next
Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the complaining party does not file a court action within 10 business days, we may restore the removed content.
5Repeat infringer policy
Account termination policy
It is Rally Foundation's policy, in appropriate circumstances, to terminate accounts of account holders who are repeat infringers.
We may terminate a user's access to the Rally platform if they are subject to repeated DMCA takedown notices or are otherwise determined to be willfully infringing copyrights.
Factors we consider include:
- Number of DMCA notices received.
- Whether the user filed counter-notifications.
- Whether the content was restored after counter-notification.
- The user's response to infringement claims.
