This Privacy Notice applies to the processing of personal information by Rally Foundation, including via rally.fun and our other online or offline offerings.

1Updates to this Privacy Notice

We may update this Privacy Notice from time to time in our sole discretion. If we do, we'll let you know by posting the updated Privacy Notice on our website, and/or we may also send other communications.

2Personal information we collect

We collect personal information that you provide to us, personal information we collect automatically when you use the Services, and personal information from third-party sources, as described below.

A. Information you provide to us directly

We may collect personal information that you provide to us.

  • Account information: When you link your social media account, we may collect your username, wallet address, and other information you store with your account.
  • Campaign information: Information in connection with the reward-based campaigns you participate in or launch on approved blockchain and social media platforms.
  • Social media information: Social media handles, engagement information, and content you post.
  • Transactions: Wallet addresses or information about who you transact with. Your interactions with third-party wallet services are subject to each wallet provider's respective privacy notice.
  • Your communications with us: What you communicate to us, such as through email.
  • Surveys: Information you provide if you decide to participate in surveys.
  • Interactive features: Anything you submit through messaging features, commenting, forums, blogs, and social pages. Information you share publicly will be considered “public.”
  • Sweepstakes, promotions or contests: Personal information you provide for any sweepstakes, promotions or contests that we offer.
  • Conferences, trade shows, and other events: Personal information collected when we attend or host events.
  • Business development and partnerships: Information from individuals and third parties to assess and pursue business opportunities.
  • Job applications: Personal information provided in connection with your application.

B. Information collected automatically

We may collect personal information automatically when you use the Services.

  • Device information: IP address, user settings, cookie identifiers, browser or device information, ISP, and location information (including approximate or precise geo-location).
  • Usage information: Pages you visit, items you search for, content you interact with, links you click, frequency and duration of your activities.

We may collect personal information about you from third parties, including but not limited to:

  • Third-party services: Information shared by third-party services you connect, including connections or contacts associated with that service.
  • Blockchain information: Personal information that is available on the blockchain.

We use personal information for a variety of business purposes, including to provide the Services, for administrative purposes, and to provide you with marketing materials.

A. Provide the Services

  • Verifying your participation in campaigns.
  • Analyzing campaign performance.
  • Providing access to certain areas, functionalities, and features.
  • Communicating with you about rewards or updates.
  • Answering requests.
  • Sharing personal information with third parties as needed to provide the Services.
  • Facilitating transactions that you enter into.

B. Improve and develop new products

  • Developing, training, and fine-tuning models, algorithms, and AI technologies.
  • Improving, upgrading, or enhancing the Services.

C. Operate our business

  • Pursuing legitimate interests such as direct marketing, research and development.
  • Carrying out analytics.
  • Creating de-identified and/or aggregated information.

4How we share personal information

We share personal information with third parties for a variety of business purposes, including to provide the Services, to protect us or others, or in the event of a major business transaction.

A. Disclosures to provide the Services

  • Blockchain disclosures: Where you use aspects of the Services hosted on or interacting with the blockchain, information about your interactions and transactions, including your wallet address, will be shared with the applicable blockchain network.
  • Service providers: Hosting, customer service, AI/ML services, analytics, marketing, IT support, and related services.
  • Other users you share or interact with: The Services may allow Rally users to share information or interact with each other.
  • Third-party services you interact with: The Services may link to, interface with, or share information with third-party websites, applications, products, and technology.
  • Business partners: To provide you with a product or service you have requested or that we jointly offer.
  • Affiliates: Our corporate affiliates.
  • Advertising partners: Third-party advertising partners that may set technologies to collect information about your activities and your device.

B. Disclosures to protect us or others

We may share your personal information with external parties when we believe in good faith that doing so is required or appropriate to comply with law enforcement, legal process, protect rights, property or safety, enforce our policies, collect amounts owed, or assist with investigation or prosecution of unauthorized or illegal activity.

C. Merger, sale, or other asset transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction, your personal information may be shared, sold, or transferred as part of that transaction.

5Your privacy choices and rights

Your privacy choices

  • Email communications: Use the unsubscribe link at the bottom of any marketing email. You will not be able to opt out of certain communications (e.g., service updates or updates to this Privacy Notice).
  • “Do not track”: We do not currently respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
  • Cookies: You may stop or restrict the placement of technologies on your device by adjusting your browser or device preferences. If you do so, the Services may not work properly.

Your privacy rights

In accordance with applicable law, you may have the right to:

  • Request access to or portability of your personal information.
  • Request correction of your personal information.
  • Request deletion of your personal information.
  • Request restriction of or object to our processing.
  • Withdraw your consent to our processing.

6International transfers of personal information

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live.

If we transfer personal information from the European Economic Area, Switzerland, and/or the United Kingdom to a country that does not provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

7Retention of personal information

We store the personal information we collect as described in this Privacy Notice for as long as you use the Services, or as long as necessary to fulfill the purpose(s) for which it was collected, or as long as necessary to pursue our business purposes.

To determine the appropriate retention period for personal information, we may consider applicable legal requirements; the amount, nature, and sensitivity of the personal information; certain risk factors; the purposes for which we process your personal information; and whether we can achieve those purposes through other means.

8Supplemental notice for EU / UK GDPR

This Supplemental Notice for EU/UK GDPR applies only to our processing of personal information that is subject to the EU or UK General Data Protection Regulation.

Rally's processing of your personal information may be supported by one or more lawful bases including performance of contract, legitimate interest, consent, and compliance with legal obligations.

9Children's personal information

The Services are not directed to children under 18 (or other age as required by local law outside the United States), and we do not knowingly collect personal information from children.
